In U.P., state to have upper hand in DGP selection

Lucknow: A new rule has been made for appointment to the post of Director General of Police (DGP) in Uttar Pradesh. It has also been approved by the cabinet. Now a provision has been made for a nomination committee for the appointment of DGP. The chairman of the committee will be a retired judge of the High Court. Also, the committee will have the Chief Secretary of the state, one person each nominated by the Union Public Service Commission and the UP Public Service Commission, Additional Chief Secretary Home and a retired DGP.

It has been decided in the rule that only that officer will be appointed as DGP whose service period must be at least six months left. Along with this, the minimum tenure of the DGP should be two years. On appointment of the DGP, he must be given a tenure of at least two years. If his service period is only six months left after appointment, then the service period can be extended.

If the appointed DGP is found to be involved in any criminal case or corruption or incapable of performing his duties, then the government can remove him even before the completion of his two-year tenure. To remove the DGP from his post, it will be necessary to follow the instructions of the High Court in the relevant provisions. According to the rules, only those officers will be selected for the post of DGP who are working on the post of Director General of Police in level 16 of the pay matrix.

The Supreme Court had asked the state governments to make a new Police Act on 22 September 2006 in the case of writ petition Prakash Singh and others vs Union of India and others so that the police system is kept free from any kind of pressure. This system can prove to be capable of protecting the rights of citizens and establishing the rule of law. The High Court has also hoped that the new rules do not ignore the order of the Supreme Court. The purpose of the Appointment Rules-2024 is to establish an independent and transparent mechanism for the selection of a suitable person for the post of DGP of UP so that it can be ensured that the said selection is free from political or executive interference.
